7. Sensitive Personal Data

With your consent, we may collect sensitive personal data such as bank account, credit/debit card, or other payment instrument information in order to enable certain features on the Platform. You may always choose not to provide such information by opting not to use the related feature — this may however affect your access to that feature.

8. Third-Party Platforms

When a third-party business partner (such as a payment processor) collects your personal data directly from you, you will be governed by their privacy policies. We are not responsible for such third parties' privacy practices, and we recommend reviewing their policies before disclosing any information.

9. Data Retention & Deletion

You can delete your account anytime from your profile settings, which will remove your account information. We may delay deletion if there is a pending grievance, claim, or booking. We retain personal data only as long as necessary for the purpose it was collected, or as required by law, and may retain anonymised data for analytics and research.

By providing your information on the Platform, you consent to us contacting you via SMS, instant messaging apps, calls, and/or email for the purposes described in this Privacy Policy. You may withdraw this consent at any time by writing to us at support@lytm.in with the subject "Withdrawal of consent for processing personal data." Withdrawal is not retrospective, and we may restrict certain services where the withdrawn information was necessary to provide them.

LYTM experts are verified professionals. However, LYTM is not liable for any damage caused due to allergic reactions or improper use of customer-provided products. Please inform your expert of any known allergies before the service begins.

7. Limitation of Liability

LYTM's liability is limited to the amount paid for the specific booking in question. We are not liable for indirect, incidental, or consequential damages arising from the use of our services.

8. Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka.

9. Electronic Record

This document is an electronic record under the Information Technology Act, 2000 and its amended provisions, and is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011. It is generated by a computer system and does not require any physical or digital signature.

10. Accuracy of Information

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness, or suitability of the information and materials offered on the Platform for any specific purpose. Such information and materials may contain inaccuracies or errors, and we expressly exclude liability for such inaccuracies or errors to the fullest extent permitted by law.

11. Use at Your Own Risk

Your use of the Platform and Services is solely and entirely at your own risk and discretion, for which we shall not be liable to you in any manner. You are required to independently assess and ensure that the Services meet your requirements.

12. Intellectual Property

The contents of the Platform and the Services — including design, layout, look, and graphics — are proprietary to us or licensed to us. You have no authority to claim any intellectual property rights, title, or interest in such contents. Unauthorized use of the Platform and/or Services may lead to action against you as per these Terms and/or applicable law.

13. Third-Party Links

The Platform and Services may contain links to third-party websites. Accessing these links means you are governed by the terms of use, privacy policy, and other policies of such third-party websites. These links are provided solely for your convenience.

14. Binding Contract

By initiating a transaction for availing the Services, you enter into a legally binding and enforceable contract with the Platform Owner for those Services.

15. Indemnification

You shall indemnify and hold harmless the Platform Owner, its affiliates, group companies, and their respective officers, directors, agents, and employees from any claim, demand, or action — including reasonable attorney's fees — made by any third party, or penalty imposed, arising out of your breach of these Terms, the Privacy Policy, other policies, or your violation of any law, rule, regulation, or third-party rights (including intellectual property rights).

16. Force Majeure

Neither party shall be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event beyond that party's reasonable control.

Refund & Cancellation Policy

1. Cancellation Window

Cancellations will only be considered if the request is made within 2 hours of placing the booking. Cancellation requests may not be entertained if the booking has already been communicated to and accepted by the assigned expert, or the expert is already on the way. In such cases, you may choose to decline the service at your doorstep.

2. Non-Cancellable Items

LYTM does not accept cancellation requests for perishable items (e.g. flowers, consumables) used as part of a service. However, a refund or replacement can be made if you establish that the quality of the item/product delivered was not good.

3. Damaged or Defective Items

If you receive a damaged or defective item as part of your service, please report it to our customer service team within 3 days of receipt. The request will be reviewed once the concerned expert/merchant has checked and confirmed the issue on their end.

4. Service Not as Described

If you feel the product or service received does not match what was shown on the Platform or your expectations, please notify our customer service team within 3 days of receiving the service. Our team will review your complaint and take an appropriate decision.

5. Manufacturer Warranty

For complaints regarding products that come with a manufacturer's warranty, please refer the issue directly to the manufacturer.

6. Refund Timeline

Once a refund is approved by LYTM, it will take 3 business days to be processed to your original payment method.
